1. Introduction

New Grasp Academy provides live online English lessons designed for children aged 4 to 13 who are learning English as a foreign language. These Terms govern your use of our Website and services.

2. Eligibility

By using our Website, you confirm that:

• You are at least 18 years old and legally capable of entering into binding agreements.

• You are registering on behalf of a child aged 4 to 13 and are their parent or legal guardian.

• Children cannot create or manage accounts directly; all accounts must be created and managed by a parent or legal guardian.

3. Services

New Grasp Academy provides:

• Live English sessions conducted by certified teachers.

• CEFR-aligned programs tailored for young learners.

• Trial classes (free or paid) to assess the child’s English level and platform suitability.

We may modify, suspend, or discontinue any part of our services at any time without prior notice.

4. Registration and Account Responsibilities

To access our services, you must create an account and:

• Provide accurate, complete, and current information.

• Maintain the confidentiality of your login credentials.

• Notify us immediately of any unauthorized account use.

We reserve the right to suspend or terminate accounts for any violation of these Terms.

5. Payments and Refunds

a. Payments

• All sessions must be prepaid using the methods available on the Website.

• Prices are displayed in the applicable regional currency and include taxes unless otherwise stated.

• Payments must be made on time; failure to do so may result in service suspension or contract termination.

b. Refund Policy

• For 1-month and 3-month subscriptions: Refunds are available for unused sessions within the first 7 days of the subscription start date.

• For 6-month and 12-month subscriptions: Refunds are available for unused sessions within the first 50 days of the subscription start date.

• After the refund period ends, no refunds will be issued. Learners may continue with their remaining sessions until the subscription expires.

• If we cancel a session and cannot assign a substitute teacher, we will reschedule or refund that session.

• Complaints about class quality must be submitted within 24 hours of the session for consideration.

6. Cancellations, Absences, and Rescheduling

• Each student may cancel or reschedule up to two (2) sessions per month without penalty, provided notice is given at least 8 hours in advance.

• Any cancellations or absences beyond this limit will result in the session being deducted from the student’s balance and considered non-refundable.

• Missed sessions cannot be carried over to the following month.

• Rescheduled sessions are subject to teacher and schedule availability.

• Cancellations made within less than 8 hours will result in the session being deducted from your balance.

• If a teacher cancels and a suitable substitute is not available, the session will not be deducted.

7. Freeze Policy

• Students may freeze their subscription once within every 6-month period, for a maximum of two (2) weeks only.

• Additional freeze requests will not be accepted.

• Any missed sessions beyond the allowed freeze period will be considered forfeited and non-refundable.

8. Trial Classes

• Trial classes are offered to help assess your child’s level and get familiar with the platform.

• Teachers for trial classes are assigned by New Grasp and cannot be chosen by users.

• Completion of a trial class may be required before purchasing a subscription.

9. User Conduct

You agree to:

• Use our services only for lawful purposes.

• Ensure your child maintains respectful behavior during sessions.

You must not:

• Engage in abusive, offensive, or disruptive behavior.

• Attempt unauthorized access or upload malicious code.

• Overload or disrupt the Website, Platform, or Application.

Violations may lead to account suspension or termination.

9A. Data Protection and Privacy

• We collect and process personal data in accordance with our Privacy Policy.

• By using our services, you consent to the collection, storage, and use of your information as described in the Privacy Policy.

• Parents or legal guardians must provide consent for the collection and use of children’s personal data.

10. User Content and Data

• Users must not upload any misleading, illegal, or harmful content.

• Any content violating these Terms may be removed without notice.

• You are responsible for ensuring the accuracy and legality of submitted documents.

11. Teacher Assignment

• New Grasp assigns teachers based on availability, student needs, and schedules.

• We reserve the right to change the assigned teacher and will notify the User when applicable.

12. Intellectual Property

• All content on the Website (text, images, graphics, software, etc.) is owned by New Grasp or its licensors.

• You may not reproduce, distribute, or use any content for commercial purposes without prior written consent.

13. Limitation of Liability

To the maximum extent permitted by law, New Grasp is not liable for:

• Indirect or consequential damages from use of services.

• Technical issues or internet disruptions.

Our total liability shall not exceed the total amount paid by you in the past 12 months.

While we take appropriate measures to protect your data, no system is completely secure, and we cannot guarantee absolute protection against unauthorized access or breaches.

14. Third-Party Links

Our Website may contain links to external websites. We are not responsible for their content or practices.

15. Changes to Terms

We reserve the right to amend these Terms at any time. Updates are effective immediately upon posting. It is your responsibility to review them regularly.

16. Termination

We may suspend or terminate services if you:

• Violate these Terms.

• Fail to pay fees on time.

• Act fraudulently or abusively.

17. Force Majeure

We are not liable for delays or service disruptions due to causes beyond our control, including but not limited to natural disasters, internet outages, or regulatory actions.

18. Prohibited Use

Users are strictly prohibited from recording lessons, taking screenshots, or sharing any photos or videos of teachers, students, classroom activities, or lesson content without written permission from New Grasp Academy.
Any unauthorized recording, distribution, or publication of class material or personal images is considered a violation of this policy and may result in account suspension or legal action.
